This area of law covers review or preparation of agreements for the rent or lease of any kind of holdings, as well as any issues arising from such agreements. Rental or leasing typically involves land or property, but may also relate to the rent or lease of equipment, grazing rights, production quota, oil & gas industry access, and other holdings.
Rental and lease are two slightly different means of achieving the same purpose — the use of something which you do not own.
A rental agreement is generally for a shorter term, is often month-to-month, and rolls over automatically unless one party or the other gives notice to end the agreement. A rental agreement is more flexible and less stable than a lease situation. For example, a landlord may make a change to a rental contract without the agreement of the tenant, provided legally appropriate notice is given.
A lease agreement is a contract which rents the property for a specified time period, during which the lessor and lessee are bound to uphold the terms of the agreement. No change may be made unless so agreed by both parties. A lease may not automatically be renewed at the end of the specified period, unless specifically stated in the agreement. Often, a lease also represents a higher degree of vested interest by the leaseholder. For example, a leaseholder may choose to make improvements to a property, which is less likely in a rental situation. In general, a lease agreement involves a higher level of commitment and responsibility by the parties to each other than a rental agreement.
